This Agreement is made between Santa Sanita Semaka, the Seller of the goods offered on this online store
1. General Information
The Distance Agreement for purchase of the Goods shall be deemed to be concluded as of the time of payment for the Goods.
2. Ordering and Payment
A contract is considered valid upon successful payment confirmation to Seller's bank account. In the event that We are unable to fulfill your order, You will be promptly notified, and any amount paid will be refunded at the earliest opportunity, but no later than within 14 days from the date of such notification.
3. Shipping
Purchased goods are delivered from Latvia, Europe using VAS Latvijas Pasts services. Your order will be dispatched to the address specified in the "Address" field. Please be advised that due to the made-to-order nature of Our goods, processing of Your order may take up to 5 business days. Delivery costs are displayed before order confirmation. Shipping time and cost vary by country. More information about shipping time You can find here. In exceptional cases, We have the right to send the goods within up to 45 calendar days, informing the customer accordingly.
We do not process orders on Saturdays, Sundays, or public holidays of the Republic of Latvia. During sales events, please anticipate a processing period of up to 7 business days, to which shipping time will be added. For urgent deliveries, please email Us at [email protected].
All duties and taxes required to be paid to receive the shipment in Your delivery destination are to be paid by Buyer. Seller is not required to inform You about any such duties or taxes at any time before or after You have placed an order on www.13bracelets.com.
4. Returns Policy
Returns and Withdrawal
The Buyer has the right to return the Goods within 14 calendar days from the moment of receiving the Goods.
To exercise the right of withdrawal, You must contact us via e-mail [email protected] within 14 days of receiving the Goods.
Exceptions to the Right of Withdrawal:
The right of withdrawal does not apply if:
- The product has been used or damaged (excluding damage caused during delivery).
- The product was made for the client according to an individual order.
- The goods were purchased by a legal entity.
Reporting Shipping Errors or Damage:
Any error with your order (e.g., incorrect item shipped) or damage incurred during shipping must be reported to Us via email at [email protected] within three (3) business days of receipt. Notification received after this period will not be accepted.
Conditions for Returns:
Returned Goods must be in the exact condition they were in at the time of dispatch, with the exception of damage that occurred during shipping and was reported within the specified timeframe. The Buyer assumes liability for the item during its return.
Return Shipping Costs:
The Buyer is responsible for all return shipping fees, except in cases where the reason for the return is due to our error (e.g., incorrect item shipped) or if the Goods were damaged during shipping. In such instances, We will cover the return shipping costs.
Return Process and Refunds:
The Buyer's obligation is to return the Goods to the Seller without delay, but no later than 14 days after sending the withdrawal form to the Seller.
Upon receipt, the returned Goods will be inspected.
- If the return is due to the Buyer's withdrawal (and the goods meet the return conditions), a refund of the purchase price will be processed without delay, but no later than within 14 days of receiving the returned goods or proof of their return. The original delivery costs and any bank commission fees will not be refunded.
- If the return is due to our error (incorrect item shipped) or shipping damage reported within the specified timeframe, a full refund of the order value, including the original delivery costs, will be processed without delay, but no later than within 14 days of receiving the returned goods or proof of their return.
The Seller has the right to withhold payment until the Seller has received the Goods back from the Buyer or proof of their return.
Force Majeure:
The Seller is not responsible for delays in the performance of obligations or non-performance, or other types of non-performance, that have arisen due to circumstances and obstacles beyond the online store's reasonable control.
5. Handling of Claims and Product Defects
The Seller is liable for any lack of conformity of the Goods with the terms of the contract or for defects that become apparent within 6 months from the date of delivery to the Buyer, including defects present at the time of delivery, unless this presumption is incompatible with the nature of the Goods or the nature of the defect. The Buyer must inform the Seller of the non-conformity of the Goods without delay, and in any event within 2 months after the Buyer detected the lack of conformity, by submitting a complaint. The Buyer can submit a complaint by contacting the Seller via email at [email protected]
The Seller is not liable for defects that occur after the Goods have been delivered to the Buyer. If the purchased Goods are not in conformity with the contract, and the Seller is responsible for this, the Buyer is entitled to request that the Seller remedy the non-conformity by repair or replacement of the Goods free of charge.
If the Goods cannot be repaired or replaced, the Buyer has the right to a proportionate reduction of the price or the termination of the Distance Agreement and a full refund of all payments made under it. The Seller will provide a written response to the Buyer's complaint within 15 days.
Exclusions for Claims:
The Seller will not accept claims for defects if:
- The defect has arisen as a result of improper use of the Goods, failure to adhere to the Seller's recommendations or instructions.
- The defect has been caused by the Buyer's careless handling or improper opening or movement of the product.
- The Goods are completely used, lost, or otherwise unavailable for the Seller to inspect the alleged defect.
6. Buyer's Personal Data
The personal data We process is limited to the information provided by the Buyer during the order placement process, including but not limited to name, surname, address, phone number and email address.
For the sole purpose of facilitating the delivery of your purchased goods, we will share relevant personal data with transport service providers.
With Your express consent to receive marketing communications, such as Our newsletters and promotional materials, We may periodically contact You with information regarding Our services and new offerings. To this end, We may process the email address you provided when subscribing to these communications. You retain the right to withdraw Your consent and unsubscribe from marketing communications by informing Us via email at [email protected].
7. Dispute Settlement
Matters not explicitly outlined in these terms and conditions shall be subject to the prevailing legal framework of the Republic of Latvia.
The Seller and the Buyer agree to initially resolve any disagreements through amicable negotiation or written communication. Should these efforts prove unsuccessful, the dispute shall be submitted to the jurisdiction of the courts within the Republic of Latvia, in accordance with its applicable laws. Consumer Buyers are also entitled to refer disputes to the Consumer Rights Protection Centre or the courts of Latvia.
Furthermore, the Buyer retains the right to engage the dispute resolution mechanisms provided by the European Union.
